Fatal Pool Accident Ruling

The Fukuoka District Court ordered Ibusuki Seaside Hotel in Kagoshima to pay more than ¥80 million to the family of a 21-year-old woman who drowned in its pool in July 2022. She died after attempting to assist her younger sister in an area where the depth dropped suddenly to two meters. The family sought over ¥148 million, arguing that the hotel failed to provide adequate warnings or lifeguard supervision. The court found that users were unlikely to recognize the depth change and that signage did not sufficiently alert swimmers to the risk, concluding the hotel neglected its duty of care.
